Your Rights During a Criminal Investigation.

During a criminal investigation in India, you have fundamental rights, including the right to remain silent to avoid self-incrimination, the right to be informed of the grounds of arrest immediately, the right to legal counsel, and the right to be produced before a magistrate within 24 hours.


Key Rights During Investigation and Arrest:

  1. Right to Remain Silent: Under Article 20(3) of the Constitution, you cannot be forced to answer questions that might incriminate you.
  2. Right to Know Grounds of Arrest: Police must inform you immediately why you are being arrested.
  3. Right to Legal Counsel: You have the right to consult a lawyer of your choice, including during interrogation.
  4. Production Before a Magistrate: You must be produced before the nearest magistrate within 24 hours of arrest.
  5. Right Against Illegal Detention: You cannot be detained without proper legal procedures.\
  6. Medical Examination: You have the right to be examined by a medical practitioner to prevent custodial torture.
  7. Female Accused Rights: Women can only be arrested by female officers and, generally, not before sunrise or after sunset.

What to Do:

  1. Remain Calm and Polite: Cooperate with identification but assert your rights.
  2. Request a Lawyer: Ask for legal representation immediately.
  3. Avoid Signing Documents: Do not sign any confession or statement without your lawyer reviewing it.
  4. Exercise Silence: If you are unsure, do not answer questions; politely state you will only talk with a lawyer present.
